Accessibility Services Terms

EFFECTIVE: SEPTEMBER 24, 2026 (2026-09-24)

These terms cover the free accessibility scan at elliotts.ai/accessibility/scan and the paid accessibility audit, remediation, verification and monitoring services described at elliotts.ai/accessibility. In these terms, “elliotts.ai”, “we” and “us” mean the business that operates elliotts.ai, and “you” means the person or business using the scan or buying the services. By running a scan, paying for an audit online, or starting a paid engagement, you agree to these terms.

1. We are not a law firm

elliotts.ai is a web design and development studio. We are not a law firm and we do not practise law. Nothing we say, write, publish or deliver, including scan results, audit reports, conformance reports and accessibility statements, is legal advice. Our work is technical remediation, not legal advice. Using our scan or our services does not create an attorney-client relationship.

Consult your own lawyer about your obligations under the Americans with Disabilities Act (ADA), Section 508, state law or any other rule, and about any demand letter, complaint or lawsuit you receive.

2. No guarantee of a legal outcome

We do not guarantee that your website complies with the ADA, Section 508, any state law, or any other law or regulation. We do not guarantee that you will not receive a demand letter, a lawsuit, or a regulatory complaint or action. Conformance with the Web Content Accessibility Guidelines (WCAG) 2.2 Level AA reduces that risk. It does not remove it.

3. The free scan

The free scan is an automated check of a single page, your homepage, at one point in time. Automated tools catch only a portion of accessibility issues, and results may include false positives (issues reported that are not real barriers) and false negatives (real barriers the tool does not detect). The scan is not an audit, a certification or a legal opinion, and you must not present its results as a certificate or statement of compliance.

The scan is provided “AS IS”, free of charge, and with no warranty of any kind. We may decline, limit or rate-limit scans at our discretion, and we may change or withdraw the scan at any time.

By requesting a scan, you confirm that you are authorized to request a scan of the address you enter. The scan loads that public page once, the way an ordinary visitor's browser would. We use the email address you give us to send the results and may follow up once. See our privacy policy.

4. Paid services

The scope, fees, schedule, deliverables and acceptance for any paid remediation, verification or monitoring work are set by the Statement of Work you sign with us. If a signed Statement of Work conflicts with this page, the Statement of Work controls.

The flat-fee audit can also be bought online at the published price. For an audit bought that way, your order and these terms apply in place of a signed Statement of Work. We confirm the site and scope by email before we start. If we cannot take the site on, we refund the fee in full. Once work on the audit has started, the fee is not refundable. If you also sign a Statement of Work that covers the audit, the Statement of Work controls.

Remediation means real changes to your site's code or content management system. Conformance is assessed as of the date of our verification only. Content, pages, plugins, themes, third-party widgets and redesigns added or changed after that date can introduce new barriers, and they are not covered unless they are part of an active monitoring plan or a new Statement of Work.

Systems outside our control are excluded, including third-party platforms, embedded services, payment and booking widgets, hosted checkout pages, and vendor code we cannot change. Where one of these creates a barrier, we will tell you and, where we can, suggest what to ask the vendor for.

5. Disclaimer of warranties

To the fullest extent the law allows, the scan, our reports and our services are provided “AS IS” and “AS AVAILABLE”. We disclaim all implied warranties, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement. Any warranty we do give is the one written into your signed Statement of Work, and no other. For an online audit order with no signed Statement of Work, our only commitment is to deliver the audit described at elliotts.ai/accessibility with reasonable skill and care, and your remedy if we cannot take the site on is the full refund in section 4.

6. Limitation of liability

To the fullest extent the law allows, our total liability for any claim arising from the scan or our services is limited to the fees you paid us for the specific service the claim relates to in the 12 months before the claim arose. For the free scan, that amount is zero.

We are not liable for any indirect, incidental, consequential, special or punitive damages, or for lost profits or lost revenue. We are not liable for any settlement, judgment, plaintiff's attorney fees or other legal costs arising from any accessibility claim, demand letter, lawsuit or regulatory action, whether or not we were told such a claim was possible.

7. Your responsibilities and indemnity

You are responsible for your content, for your website after we hand work over to you, and for your own legal and compliance decisions, including what you publish in an accessibility statement.

You agree to indemnify and hold us harmless against claims, losses and costs arising from your website, your content, or your use of our scan results or reports, except to the extent they were caused by our gross negligence or willful misconduct.

8. Governing law and venue

These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Philadelphia County, Pennsylvania, and you and we consent to that venue.

9. Changes to these terms

We may update these terms. The effective date at the top of this page shows when they last changed. Changes apply to scans run, audits ordered online and engagements started after that date. An online audit order keeps the terms that applied when it was paid for, and a signed Statement of Work keeps the terms that applied when it was signed, unless both sides agree otherwise.
